This policy explains how we collect, hold, use, disclose and protect personal information. It applies to information we collect through this website, and to information we collect in the course of providing training and assessment services.
We are committed to handling personal information in accordance with the Australian Privacy Principles (APPs) set out in the Privacy Act 1988 (Cth).

In this policy, “we”, “us” and “our” refer to ACT Training (ACTM) trading as ACTM Training & Consultancy, a registered training organisation, Registration Code: 2927.
Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable.

Some of the information we collect during enrolment and training is sensitive information under the Privacy Act — for example, health information you give us so we can make adjustments to support your learning. We only collect sensitive information where you consent and it is reasonably necessary for our functions, or where the law requires or authorises us to.
We do not collect Tax File Numbers through this website.
We collect personal information directly from you wherever we reasonably can — through this website’s enquiry form, by email, by telephone, in person, and through enrolment and assessment documentation.
We may also collect personal information from a third party, such as your employer where they arrange or fund your training, or a regulator or referring organisation. Where we do, we take reasonable steps to make sure you know we have collected it and why.
You can deal with us anonymously or under a pseudonym for general enquiries. However, we cannot enrol you in nationally recognised training, issue a qualification, or report to regulators without identifying you.

When you submit an enquiry through this website, the information you provide is sent to us by email and retained in our business systems so that we can respond to you. Depending on the nature of your enquiry, we may also record it in our student or enquiry records — for example, where your enquiry leads to an enrolment.
We use your enquiry details to answer your question and to provide information about the training you have asked about.
We do not add your enquiry details to any marketing or mailing list without your consent.
We keep enquiry records for 24 months, unless your enquiry becomes part of a student record, in which case the retention periods in section 12 apply.
This website uses measures to reduce automated spam submissions. These do not collect additional personal information about you.
When you visit this website, our systems automatically collect certain technical and usage information, including your IP address, browser type and version, device type, the pages you visit, the date and time of your visit, how you interact with the site, and the website or search engine you came from.

However, some of the third-party services we use to operate this website — including analytics and search services — are provided by organisations that store and process data on servers located outside Australia, including in the United States. Where this occurs, we take reasonable steps to ensure the recipient handles the information consistently with the Australian Privacy Principles, including by choosing reputable providers with published privacy commitments.

These steps include restricting access to staff who need it, using secure connections for information submitted through this website, applying access controls and passwords, maintaining backups, and securely destroying or de-identifying information we no longer need.
No method of transmission over the internet is completely secure. While we take reasonable steps to protect the information you send us, we cannot guarantee the security of information transmitted to us online.
We keep personal information only as long as we need it, or as long as the law requires. As a registered training organisation we are subject to specific retention periods:

Where more than one period applies to the same record, we retain it for the longest applicable period.
When we no longer need personal information and are not required to keep it, we destroy it or de-identify it securely.
You can ask us for access to the personal information we hold about you, and you can ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading.
To make a request, contact us using the details in section 16. We may need to verify your identity before we can act on your request.
We will respond within a reasonable period, normally within 30 days. Access is free, though we may charge a reasonable fee for the cost of providing copies. If we refuse a request, we will tell you why in writing and explain how you can complain.
If a data breach occurs that is likely to result in serious harm to any individual whose personal information is involved, we will assess it promptly and, where required, notify the affected individuals and the Office of the Australian Information Commissioner in accordance with the Notifiable Data Breaches scheme.
If you believe we have breached the Australian Privacy Principles or mishandled your personal information, please contact us first using the details in section 16. Set out what happened and how you would like it resolved.
We will acknowledge your complaint within 14 days and will tell you the outcome in writing once we have investigated.
